New Policy 113 - Ban on Anonymous Communication

At the June 29, 2019 board meeting, the board voted unanimously to Policy 113, BAN ON ANONYMOUS MATERIALS, EMAILS, LETTERS, FLYERS, COMMUNICATIONS, AND FINES FOR VIOLATIONS. This policy was created to prohibit owners from distributing materials anonymously to other owners.

BAN ON ANONYMOUS MATERIALS, EMAILS, LETTERS, FLYERS, COMMUNICATIONS, AND FINES FOR VIOLATIONS

California Civil Code allows owners to distribute or circulate materials “in a reasonable manner.” The reasonableness standard allows HOAs to adopt rules and policies regarding the dissemination of any materials, emails, letters, etc., and that includes a requirement that anyone disseminating materials, letters, emails etc., must identify themselves on the materials, emails, letters, etc., and cannot disseminate any materials, emails, letters, etc anonymously.
Policy 113 prohibits any person or group of persons from disseminating any materials, emails, letters, etc., without identifying themselves on the materials, emails, letters, etc.
Anonymous materials, emails, letters etc., are not allowed.
If any person or group of persons disseminates any materials, emails, letters etc. anonymously in violation of Policy 113, a fine of $50 per recipient may be assessed, after a hearing, for each material, email, letter etc, that is anonymously disseminated, but in an amount not to exceed $1,000 per material, email, letter, etc.
